Civil Suit / Ruling on Application for Leave to Amend Plaint

  1. 1 Whether the plaintiff should be granted leave to amend the plaint to include figures of special damages.
  2. 2 Whether the proposed amendment would prejudice the defendants or cause injustice.
  3. 3 Whether the delay in seeking amendment is excusable.

Ratio Decidendi

The court held that the discretion to allow amendment of pleadings should be exercised to do justice and avoid shutting out a party on technicalities. The applicant satisfied the cardinal test that the amendment is necessary for determining the real question in controversy, namely the inclusion of a pecuniary claim for special damages. The court found that the amendment would not prejudice or cause injustice to the defendants, as any injury could be compensated by costs. The delay in seeking amendment was not found to be fatal, and the principles guiding amendment of pleadings, including the avoidance of multiplicity of proceedings and the need for substantive justice, were satisfied....

Court Disposition

Application allowed. Leave granted to amend plaint as sought.
