Procedural Posture

Land and Property Dispute / Judgment

  1. 1 Whether the Plaintiff is the legal owner of LR.No.Ruiru/Ruiru East Block 2/1404.
  2. 2 Whether the Defendant is a trespasser on the suit land.
  3. 3 Whether the Defendant acquired title by adverse possession.

Ratio Decidendi

The Plaintiff's suit was dismissed for want of prosecution as neither the Plaintiff nor her advocates appeared in court to prosecute the claim. The Defendant's counterclaim, based on allegations of fraud and adverse possession, failed because she did not provide sufficient evidence to prove fraud in the registration of the Plaintiff's title or to establish the elements required for adverse possession. The court found that the Defendant did not discharge the burden of proof as required by law, and there was no credible evidence from the Lands Office or otherwise to support her claims. Consequently, both the Plaintiff's suit and the Defendant's counterclaim were dismissed.

Court Disposition

Both the Plaintiff's suit and the Defendant's counterclaim are dismissed. No orders as to costs.

Orders
