The court found that although Certificate No. 15 was not part of the original Mombasa suit, the IRAC Report—commissioned by consent and adopted by the Mombasa High Court—established that the Defendant had overpaid the Plaintiff by Ksh.28,440,268.14 as at 7th January 1998. After debiting the amount due under Certificate No. 15 (Ksh.17,701,448.10), the overpayment stood at Ksh.10,738,820.04. The Plaintiff did not challenge the adoption of the IRAC Report by way of review or appeal, and the findings therein remain binding.
