To allow the application would amount to sitting on appeal over those decisions, which the court cannot do. The court further held that, under section 427(1) of the Insolvency Act, it retains discretion at the hearing of the petition to make any appropriate order, and the mere filing of a liquidation petition does not preclude the debtor from challenging the petition...
