The Tribunal found that the claimant had indeed defaulted on a loan for which livestock was expressly provided as security in the loan agreement. The respondent was therefore entitled to attach and sell the livestock upon default. The process of attachment and sale, while not perfect in terms of notice and advertisement, was not shown to be unlawful or in breach of the security agreement. The Tribunal was not convinced that the proceeds from the sale were insufficient to cover the outstanding loan, and the claimant failed to provide evidence of full repayment or to substantiate the alleged value of the livestock beyond the amounts realized.
