Ratio Decidendi

The court held that the only lawful beneficiaries of the estate of the late M’Murithi Gituoki are his two sons, M’Itonga M’Murithi and M’Inoti M’Murithi, as provided by Section 38 of the Law of Succession Act. There was no evidence that any grandchild was a dependant of the deceased within the meaning of Section 29 of the Act. The court rejected the petitioner’s proposal to distribute the share of the late M’Inoti directly to specific grandchildren, holding that such distribution would be contrary to law. The share due to the late M’Inoti must remain in his estate until a proper succession cause is mounted for his estate, and only then can the distribution among his heirs be determined....
