The explanation that the Covid-19 pandemic caused the delay was rejected, as court operations were only briefly affected and mechanisms for electronic filing were in place. The 16-month delay in seeking leave to appeal was deemed inordinate and unexplained. The court held that granting the orders sought would be prejudicial to the respondent and contrary to the principles of equity and the overriding objective of the court. Consequently, the application for stay of execution and leave to appeal out of time was dismissed for lack of merit.
