The Tribunal found that the tenant had demonstrated a genuine and well-founded fear of imminent eviction following service of a termination notice by the landlord. The Tribunal held that the application for injunction was properly before it, as the tenant had filed the requisite reference under Section 6(1) of Cap. 301. Applying the principles in Giella v Cassman Brown, the Tribunal determined that the tenant had established a prima facie case and would suffer illegality and irreparable harm if evicted before the reference was heard and determined.   • A temporary injunction is granted restraining the landlord, his servants, employees and/or agents from evicting the tenant or interfering with the tenant's quiet occupation and lawful enjoyment of the suit premises pending hearing and determination of the reference.
  • The tenant shall pay in full all the rent owing to the landlord in respect of the suit premises within 45 days, failing which the landlord shall be entitled to levy distress.
