The court found that, although the plaintiffs' advocates received notice of the judgment within the statutory period for appeal, the period of court vacation (21st December to 13th January) must be excluded from the computation of time under Order 50 Rule 4 of the Civil Procedure Rules. Deducting this period, the delay in filing the application for leave to appeal out of time was only four days, which was not inordinate. The court exercised its discretion in favour of the plaintiffs, granting leave to appeal out of time.
