Furthermore, the applicant was not truthful about when he became aware of the petition and failed to explain the four-year delay in bringing the application. The court held that the delay was inexcusable and that the application lacked merit both on substance and on procedural grounds. Consequently, the application for review was dismissed with costs to the respondent.
