Ratio Decidendi

The Tribunal found that although the respondent was duly served and his advocate entered appearance, the failure to file a defence was not explained. However, the draft defence raised triable issues requiring further interrogation, and the principles of natural justice favour allowing a hearing on the merits. The Tribunal exercised its discretion to set aside the interlocutory judgment, subject to payment of thrown-away costs. Additionally, since there was a pending appeal (CTA E011 of 2022) involving the same subject matter and parties, the Tribunal held that the sub-judice rule applied and stayed the proceedings pending the outcome of the appeal, to avoid conflicting decisions.
