Ratio Decidendi

The court found that neither party had adduced sufficient evidence to prove cruelty as a ground for divorce. The respondent's claim of desertion was countered by her assertion that her travel abroad was mutually agreed for the family's benefit. However, the court observed that the parties had been separated since 2004, had lived apart since then, and the petitioner was in another relationship. The court concluded that the marriage had irretrievably broken down and that sustaining it would cause further anxiety and psychological torture. Accordingly, the marriage was dissolved on the ground of irretrievable breakdown.
