The High Court found that the Kadhis Court exceeded its jurisdiction by granting orders on custody and maintenance of children, as its jurisdiction is strictly limited by the Constitution and the Kadhis Court Act to matters of Muslim Law relating to personal status, marriage, divorce, or inheritance, and only where all parties are Muslims and submit to its jurisdiction. The welfare and best interest of children, including custody and maintenance, are matters reserved for the Children Court under Kenyan law.
