Ratio Decidendi

The court found that while the 1st and 2nd defendants claimed the documents were not in their possession at the close of pleadings, there was insufficient justification for introducing most of the documents after the hearing had commenced. Allowing such documents would prejudice the plaintiff and risk delaying the proceedings. The only exception was the Kenya Gazette Notice, a public document, whose admission would not prejudice the plaintiff. The court exercised its discretion to allow only this document to be filed and served within 14 days, and declined to admit the other documents sought by the defendants. Each party was ordered to bear its own costs for the application.

  • Leave granted to the 1st and 2nd defendants to file and serve a supplementary list and bundle of documents comprising only Kenya Gazette Notice Vol. CVI – No. 18 of 20/2/2004 within 14 days.
