Procedural Posture

Tax Appeal / Judgment

  1. 1 Whether the Respondent’s rejection of the Appellant’s application for extension of time to lodge an objection notice was justified.
  2. 2 Whether the Tribunal could interrogate the merits of the Respondent’s refusal decision in the absence of the Appellant’s application for extension of time.

Ratio Decidendi

The Tribunal found that its jurisdiction in this matter was confined to reviewing the application for extension of time and the Respondent’s refusal. The Appellant failed to annex its application for extension of time to the appeal, thereby preventing the Tribunal from scrutinising the merits of the Respondent’s refusal. Without the application, the Tribunal could not assess whether the Respondent’s decision was justified. As a result, the Tribunal was constrained to strike out the appeal for want of the necessary documentation, as the absence of the application for extension of time was fatal to the Appellant’s case.
