The court held that while the Civil Procedure Act and Rules allow for amendments to pleadings to correct errors or include necessary material for determination of the suit, such amendments cannot be used to introduce a wholly new cause of action that is already barred by statutory limitation periods. The defamation claim, based on a letter dated 7th September 2017, was introduced by amendment on 19th August 2019, which was outside the twelve-month limitation period prescribed for libel actions.
