The plaintiff admitted to having discovered the alleged fraud in 1997. Under Section 4(2) of the Limitation of Actions Act, actions founded on tort (including fraud) must be brought within three years, and under Section 7, actions to recover land must be brought within twelve years. The suit was filed in 2013, more than sixteen years after the cause of action arose, and no leave for extension of time was sought.
