Procedural Posture

Civil Appeal / Ruling on Interlocutory Application and Withdrawal of Suit

  1. 1 Whether the court should grant an injunction restraining the defendants from interfering with the applicants' business operations and premises.
  2. 2 Whether the applicants' conduct amounted to abuse of court process and forum shopping.
  3. 3 Whether the suit should be marked as withdrawn and costs awarded against the applicants.

Ratio Decidendi

The court found that the applicants had engaged in conduct amounting to abuse of court process by filing and withdrawing suits in an attempt to forum shop and evade the court's directions. The applicants ignored previous reprimands and continued to misuse the litigation process. In light of the notices of withdrawal filed by the applicants, the court determined that it could not entertain further interlocutory motions. The court adopted the notices of withdrawal, marked the suit as withdrawn, and condemned the 1st applicant to pay the costs of the consolidated suit as a sanction for their intransigence and abuse of process.

Court Disposition

Suit withdrawn; costs awarded against 1st applicant.

Orders

  • The two notices of withdrawal dated 3rd October 2024 and 14th October 2024 are adopted and allowed.
  • The 1st Plaintiff/Applicant is condemned to pay the costs of the consolidated suit.
