The trial court failed to adequately consider these mitigating factors and the applicant's inability to pay the fine. The High Court, exercising its revisionary jurisdiction, held that the period already served in custody was sufficient punishment and substituted the original sentence with imprisonment for the period already served, ordering the applicant's immediate release unless otherwise lawfully held.
