The Court of Appeal held that it has no jurisdiction to hear a second appeal from the High Court in an election petition concerning the nomination of members of a County Assembly. This is because section 85A of the Elections Act does not provide for a right of second appeal in such matters, and appellate jurisdiction must be expressly conferred by statute. The Court reaffirmed its previous decisions and those of the Supreme Court, which consistently held that the right of appeal is a creature of statute and cannot be implied where the law is silent.
