The High Court found that the Small Claims Court lacked jurisdiction to entertain a claim for trespass to land by virtue of section 13(5) of the Small Claims Court Act, which expressly excludes such matters. Additionally, the claim was time-barred under section 4(2) of the Limitation of Actions Act, as it was filed more than three years after the cause of action accrued. The preliminary objection raised by the respondent was proper, as it was based on undisputed facts and pure points of law. The appeal was therefore dismissed, and the appellant was ordered to pay costs to the respondent.
