  2. 2 Whether the learned Adjudicator misdirected himself on the law and principles relating to the burden of proof.

Ratio Decidendi

The High Court found that the Appellant's grounds of appeal did not raise any points of law as required for appeals from the Small Claims Court under Section 38 of the Small Claims Court Act 2016. Instead, the Appellant challenged the trial court's findings of fact, which is outside the appellate jurisdiction of the High Court in such matters. The trial Adjudicator had properly analyzed the evidence and made findings based on the material before him. The Appellant failed to demonstrate any misdirection on the law or principles relating to the burden of proof. Consequently, the appeal was found to lack merit and was dismissed with costs to the Respondent.
