Ratio Decidendi

The court found that although the 1st Defendant admitted service of the court order, he denied continuing construction thereafter. Both parties produced photographs of incomplete constructions, but the court could not determine from the evidence when the constructions occurred. The Plaintiff failed to raise the alleged contempt at the earliest opportunity when the matter was before the court, casting doubt on his allegations. The court was not satisfied that the Plaintiff had proved, to the required standard, that the 1st Defendant disobeyed the court order of 9th March, 2017. Accordingly, the application for contempt was dismissed for lack of merit.
