Ratio Decidendi

The Court of Appeal is bound by the decision of its five Judge bench in Mohammed Ali Sheikh vs. Abdiwahab Sheikh Osman Hathe & others, which held that the Court lacks jurisdiction to entertain second appeals concerning the election of a Member of County Assembly under Section 85A of the Elections Act. The appellant's arguments regarding the non-binding nature of the decision and the right of appeal to the Supreme Court do not override the binding precedent.
