The court found that although the Law of Succession Act does not stipulate a specific time for filing the record of appeal, such filing must occur without unreasonable delay. The appellant delayed for over a year without adequately pursuing the proceedings or applying for reconstruction of the file, and failed to serve the applicants with requests for proceedings. This failure precludes the appellant from relying on delay in obtaining proceedings as a justification. The inordinate delay unjustly denied the applicants the fruits of their judgment, contrary to constitutional principles of timely justice and fair hearing. Consequently, the appeal was struck out with costs to the applicants.
