The court found that the Respondent failed to establish a valid reason for terminating the Claimant's employment, as no evidence was adduced to support the allegations of theft. The Security Guard who allegedly implicated the Claimant was not called as a witness, nor was any corroborating evidence presented. Although the disciplinary process was procedurally fair, the absence of substantive justification rendered the termination unfair. The Claimant was not entitled to notice pay, salary for days worked, or overtime, as these had already been paid. He was also not eligible for gratuity due to NSSF contributions. The court therefore awarded compensation equivalent to 4 ½ months’ gross...
