The burden of proof shifted to the tenant, who did not discharge it. The court held that the tenant had not established a prima facie case with a probability of success as required for the grant of a temporary injunction. The distress for rent was found to be lawful, and the tenant's application for injunction was dismissed. However, the court extended the interim orders for sixty days to allow the tenant to clear the arrears or make arrangements with the landlord, after which the injunction would lapse if no action was taken.
