The 1st Defendant breached the licence by constructing a permanent residential structure instead of a temporary garage, thereby blocking the plaintiff's access to the road reserve and interfering with his easement rights to light and access. The 2nd Defendant, as the municipal authority, failed in its duty by approving building plans for a permanent structure on a road reserve and not enforcing the relevant by-laws. The plaintiff, as an adjoining landowner, was entitled to access the road reserve, and his rights were unlawfully infringed....
