The court relied on the precedent set in Kirinyaga General Machinery vs Hezekiah Mureithi Ireri, which held that dismissal for want of prosecution cannot be entertained before directions are given. Therefore, the application to dismiss the appeal was premature and could not be granted. The court dismissed the application with no order as to costs.
