Procedural Posture

Miscellaneous Application / Ruling on Application for Harmonization of Accounts and Refund of Overpayment

  1. 1 Whether the sum of Kshs. 29,410 was paid by the client to the advocates prior to the ruling and if it should be refunded or offset from the sum due to the advocate.
  2. 2 Whether interest should be loaded on the sum of Kshs. 29,410 paid before the filing of the bill of costs.
  3. 3 Whether the Deputy Registrar erred in calculation of interest and harmonization of accounts was necessary.

Ratio Decidendi

The court found that the sum of Kshs. 29,410 was paid by the client to the advocates before the filing of the advocate-client bill of costs and should not have been subjected to interest. The Deputy Registrar erred in loading interest on this sum. The correct approach was to deduct the Kshs. 29,410 from the sum of Kshs. 38,562.50 found due to the advocates, leaving a balance of Kshs. 9,152, which alone should attract interest at 14% per annum from 26/05/2021. The advocates are required to refund the overpaid amount to the client without interest, and the accounts are to be harmonized accordingly.

Court Disposition

Application for harmonization of accounts allowed; refund of overpayment ordered; interest recalculated.

Orders
