The court found that although there was a lawful agreement for sale between the plaintiff and the 1st Defendant, the transfer of land parcel Kilifi/Jimba/669 was void for want of valid Land Control Board consent. The minutes of the Malindi Land Control Board meeting of 24th October 1996 showed the application for consent was deferred, not approved, and the consent letter relied upon was not signed by the chair of the meeting. Furthermore, the 1st Defendant was a foreign-owned company, and under section 9(1)(c) of the Land Control Act, the Board was statutorily barred from granting consent to such a company.
