The court found that the Applicant's entry and occupation of the suit property was pursuant to an agreement with the Respondent, under which the property was to be transferred to him upon attaining the age of 65. The court held that time for adverse possession could only begin to run from the date the Applicant turned 65 and the transfer was not effected, which was 13th June, 2015. Since the suit was filed before the lapse of the requisite 12-year period (which would end on 13th June, 2027), the Applicant had not satisfied the statutory requirements for adverse possession.
