Ratio Decidendi

The court found that the appellants, having previously sought review of the tribunal's decision, were precluded from appealing on the same grounds, as this would amount to an abuse of the court process. Furthermore, the appellants failed to file the record of appeal and did not provide a copy of the impugned ruling of 6th October 2023, upon which the appeal was based. Without the essential record, the court could not determine the merits of the appeal. Consequently, the appeal was found to be incompetent and was struck out. The court ordered the appellants to bear the respondent's costs, as there was no justification to depart from the general rule that costs follow the event.
