The High Court determined that although the applicant sought extension of time to file a notice of appeal and provided reasons for the delay, the application was filed in the wrong forum. The court held that jurisdiction to grant such extension in criminal matters lies exclusively with the Court of Appeal under Article 164(3) of the Constitution and Section 379(1) of the Criminal Procedure Code. The High Court, therefore, lacked jurisdiction to entertain the application, and the proper procedure required the applicant to approach the Court of Appeal for the relief sought. Consequently, the application was dismissed for being unmeritorious and filed in the wrong forum.
