Miscellaneous Criminal Application / Ruling on Application for Review of Sentence

  1. 1 Does the High Court have jurisdiction to review a sentence imposed by another judge of concurrent jurisdiction in a criminal matter?
  2. 2 Is the applicant entitled to have the period spent in remand custody considered in the computation of his sentence under section 333(2) of the Criminal Procedure Code?
  3. 3 What is the proper forum for challenging a sentence imposed by the High Court in a criminal case?

Ratio Decidendi

The High Court lacks jurisdiction to review or revise a sentence imposed by another judge of concurrent jurisdiction in a criminal matter. The Constitution and the Criminal Procedure Code only empower the High Court to exercise revisional jurisdiction over decisions from subordinate courts, not from other High Court judges or superior courts. Any challenge to a sentence imposed by the High Court must be pursued by way of appeal to the Court of Appeal, as provided under articles 164(3) and 50(2)(q) of the Constitution and section 379(1) of the Criminal Procedure Code. The applicant's request for review is therefore incompetent and must be dismissed for want of jurisdiction.
