The court found that the trial magistrate exercised discretion judiciously in sentencing the appellant to ten years' imprisonment, which was within the statutory maximum of fourteen years for stealing stock. However, considering the value of the stolen stock, the fact that one animal was recovered, the appellant's mitigation as a first offender and sole breadwinner, and the State's concession that the sentence could be reduced, the court held that the principle of proportionality warranted a reduction of the sentence. The court substituted the ten-year sentence with a five-year term, to run from the date of initial imprisonment, finding this to be just and appropriate in the circumstances.
