The 3rd Defendant's application was therefore struck out. Regarding the application for stay, the court found that the 2nd Defendant had an arguable appeal, particularly on the issue of ability to pay the lump sum within the stipulated period. The court determined that failure to grant a stay would result in substantial loss, as the 2nd Defendant risked serving a jail term before the appeal was heard.
