The 2nd Defendant and all parties had already been heard on the admissibility of the replying affidavit before the previous bench, and there was no denial of the right to be heard. The application for review was filed with unreasonable delay, and no error apparent on the face of the record or discovery of new evidence was demonstrated. Furthermore, the 2nd Defendant had already filed a notice of appeal, which precluded the court from entertaining a review application on the same matter.
