The Tribunal found that after the expiry of the original lease, a controlled periodic month-to-month tenancy was created by operation of law when the landlord continued to accept rent from the tenant. Termination of such a tenancy can only occur in strict compliance with the statutory notice requirements under Cap 301, which the landlord had not met. The Tribunal further held that the grounds advanced by the landlord for review—namely, the expiry of the lease and alleged rent arrears—were neither new nor important matters, as they had already been raised, considered, and determined in prior proceedings. No error apparent on the face of the record or other sufficient reason was established...
