Procedural Posture

Judicial Review Miscellaneous Application / Ruling on Application by Interested Parties for Orders Relating to Company Search Certificates

  1. 1 Whether the application by the Interested Parties can be entertained in light of the subsisting stay orders in these proceedings.
  2. 2 Whether the Interested Parties are entitled to orders compelling the Registrar of Companies to issue company search certificates for Manchester Outfitters Limited for the year 2017.
  3. 3 Whether the application offends the existing court orders and is therefore incompetent.

Ratio Decidendi

The court held that the application by the Interested Parties could not be entertained due to the subsisting stay order issued on 15th October 2009, which remains in force and has not been set aside, varied, or reviewed. The effect of the stay order is to halt all further proceedings in the matter, and the request for leave to institute the application does not equate to setting aside the stay. As such, the application is unsustainable, incompetent, and fit for dismissal. The court emphasized that compliance with existing court orders is mandatory, and no further proceedings can be entertained until the stay is lifted.

Court Disposition

application dismissed with costs to the ex parte applicant and the respondents

Orders

  • The Interested Parties' application dated 12th April 2017 is dismissed.
  • Costs awarded to the ex parte applicant and the respondents.
