The Court of Appeal found that the respondent's termination was unlawful because he was not afforded a hearing prior to dismissal, as admitted by the appellant's own witness. However, the court held that reinstatement was not available since more than three years had elapsed between the dismissal and the judgment, contrary to Section 12(3)(vii) of the Industrial Court Act. The award of Ksh.2,801,333 as salary arrears for the period the respondent did not work was unjustified and exceeded the statutory maximum of 12 months' gross salary for compensation under Section 49(1)(c) of the Employment Act.
