Procedural Posture

Preliminary Objection / Ruling on Preliminary Objection Regarding Limitation of Time

  1. 1 Whether the Petition is time-barred under Section 90 of the Employment Act, 2007 and section 3(2) of the Public Authorities Limitations Act.
  2. 2 Whether the effective date of termination is the date of summary dismissal or the date the Petitioner was informed of the outcome of her appeal.
  3. 3 Whether the Court has jurisdiction to hear the Petition given the timeline of communication of the appeal decision.

Ratio Decidendi

The Court held that the effective date of termination for limitation purposes is when the employee is informed of the outcome of her appeal, not the original date of summary dismissal. Since the Petitioner was only notified of the dismissal of her appeal on 26th October 2021, the limitation period began to run from that date. The Respondents failed to provide evidence that the decision on the appeal was communicated to the Petitioner at any earlier date. Therefore, the Petition is not time-barred, and the Preliminary Objection on limitation of time is declined. The Respondents are directed to file their substantive response to the Petition.

Court Disposition
