Ratio Decidendi

Once the appeal was determined by the judgment delivered on March 16, 2023, the purpose of the deposit ceased to exist. The court, having rendered its judgment, became functus officio and had no further basis to continue holding the deposited sum as security. Therefore, the applicant was entitled to the release of the deposited funds, subject to bearing the costs of the application.
