The Tribunal held that it has jurisdiction to hear and determine appeals challenging the issuance of EIA licenses by NEMA, including issues relating to public participation, as provided under Section 129 of EMCA and Regulation 17 of the Environmental (Impact Assessment and Audit) Regulations, 2003. The Tribunal further found that the appeal was filed within the statutory 60-day period because the last day for filing fell on a Sunday, and the appeal was lodged on the next working day, in accordance with Section 57(b) of the Interpretation and General Provisions Act.
