Ratio Decidendi

The High Court found that the trial magistrate properly evaluated the evidence and was justified in holding the Appellant 100% liable for the accident, as the Respondent's version was supported by police records and credible testimony. However, the court determined that the award of Kshs. 3,000,000 in general damages for loss of dependency was excessive when compared to recent precedents for similar cases involving young adult victims. The court therefore reduced the general damages to Kshs. 2,000,000, while upholding the special damages of Kshs. 526,150 as uncontested and properly documented. Each party was ordered to bear its own costs of the appeal.
