The High Court found that the trial magistrate erred in applying the 2015 minimum wage order to a death that occurred in 2012. The correct approach was to use the minimum wage applicable at the time of death, which was the Regulation of Wages (General) (Amendment) Order, 2011. Since the deceased's earnings were not proved, the court adopted the minimum wage for unskilled workers in Kisumu, being Kshs. 7,586/-. The court recalculated the loss of dependency using this multiplicand and substituted the lower court's award with the correct sum.
