The High Court found that the trial magistrate's award of Kshs. 600,000/- in general damages was inordinately high given the nature and extent of the respondent's injuries, which, while serious, were less severe than those in the authorities cited by the respondent and more serious than those cited by the appellants. Applying the principle that comparable injuries should attract comparable awards, and guided by appellate authority on when to interfere with quantum, the court reduced the general damages to Kshs. 400,000/-.
