Criminal Revision / Ruling on Sentence Review Application
Legal Issues
- 1 Whether the applicant's sentence should be reviewed in light of his medical condition and the favourable probation report.
Ratio Decidendi
The court found that the applicant's medical condition, specifically his need for ongoing treatment following a hip replacement, constituted sufficient grounds for reviewing the sentence. The favourable probation report supported the applicant's case, and with only three and a half months remaining on his sentence, the court exercised its discretion to reduce the sentence to the period already served. This decision was made to enable the applicant to access necessary medical care outside prison, balancing the interests of justice and humanitarian considerations.
Court Disposition
Application for sentence review allowed; sentence reduced to period already served.
Orders
- The applicant's sentence is reduced to the period already served.
- The applicant to be released forthwith unless lawfully held for any other reason.

Ruling
1. The Applicant applied for review of his sentence to this court.
2. The Probation Officer filed a Sentence Review Report which states that the Applicant is in need of medication after having undergone a hip replacement.
3. The report is favourable and I find there is good reason to review the Applicant’s sentence to enable him to undergo further treatment.
4. Since the Applicant is remaining with three and a half months to complete his sentence, the review application is allowed and the sentence is reduced to the period already served.
5. The Applicant to be released forthwith unless lawfully held for any other reason.
