The trial court erred in adopting a multiplicand of Kshs. 15,000/- for loss of dependency. In the absence of evidence of the deceased’s actual earnings, the minimum wage for an Artisan Grade III in Nairobi as per the Regulation of Wages (General) (Amendment) Order, 2017 (Kshs. 21,942.35/-) should have been applied. The award for loss of dependency is set aside and substituted with Kshs. 3,510,776/-.
