Ratio Decidendi

The court found that the fine imposed by the trial magistrate exceeded the statutory maximum prescribed by Section 38(1)(a) of the Excisable Duty Act, 2015, which limits the penalty to double the excise duty payable. Since the value of the excisable goods was Ksh. 1,137.50, the maximum fine should have been Ksh. 2,275. The imposition of a Ksh. 20,000 fine was therefore illegal and excessive. The court exercised its revisionary jurisdiction under Section 362 of the Criminal Procedure Code to set aside the illegal sentence and substitute it with the lawful fine. The excess amount paid was ordered to be refunded to the applicant.
